UK GDPR Privacy Policy

1. Who We Are (The Data Controller)

This privacy policy explains how Openfield Education Ltd. (‘we,’ ‘us,’ or ‘our’) collects, uses, and protects your personal data. We are the 'Data Controller' for the personal data we process.

2. The Data We Collect and Why (Lawful Basis)

We collect, use, and store personal data under the following lawful bases as required by UK GDPR:

Children's Personal Data: As we primarily provide services to children under the age of 18, we take extra care to protect this data. For online services, including the Omniloquent platform, we rely on the parent or guardian to manage the student's personal data and consent where necessary. We do not collect or process any Special Category Data (e.g., health information) regarding academic work.


3. How We Share Your Personal Data (Third-Party Processors)

We share your personal data with third parties who help us run our business, known as 'data processors.' We only share the minimum data necessary for them to perform their services, and they are contractually bound to protect your data:

4. International Data Transfers

Your personal data is transferred to and stored by some service providers (including Google Workspace and Wix) whose operations are based outside the UK/EEA, specifically in the United States.

 

To ensure your personal data remains protected when transferred internationally, we rely on the UK International Data Transfer Agreement (IDTA) or the UK Addendum to the EU Standard Contractual Clauses (SCCs), which provide appropriate legal safeguards.

5. Data Retention and Security

  • Retention Policy: We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for. We will generally keep client and associated transaction data for a period of 7 years after the client becomes inactive, to comply with legal obligations relating to tax and accounting. Conversation logs and recordings on the Omniloquent platform are retained and may be used for AI model retraining and quality assurance, in line with our Legitimate Interest and our commitment to a robust audit strategy, as detailed in our Quality Assurance & Auditing Strategy. Recordings can be deleted by the user via the 'My Progress' link on the platform's home page.

  • Security Measures: We have put in place appropriate technical and organisational security measures to prevent your data from being accidentally lost, used, or accessed in an unauthorised way. These measures include:

    • Implementing Two-Factor Authentication (2FA) across all Google Workspace accounts.

    • Ensuring physical data access is restricted to password-protected and/or locked mobile phones and computing devices.
       

6. Cookies and Tracking

We use cookies and similar tracking technologies on our website. We use a mechanism on our site (a cookie banner) that allows you to provide clear consent to the use of any non-essential cookies. You have the right to opt-in or opt-out of these non-essential cookies.

Under UK GDPR, you have the right to:

 

  1. Access: Request a copy of the personal data we hold about you.

  2. Correction: Ask us to correct any inaccurate data we hold about you.

  3. Erasure (Right to be Forgotten): Ask us to delete your personal data. Note: For Omniloquent platform data, conversation recordings can be deleted by the user via the ‘My Progress’ link as per the Important Confidentiality Note in the Tutor Handbook.

  4. Object: Object to the processing of your personal data where we rely on a legitimate interest.

  5. Restriction: Request us to temporarily halt the processing of your data.

  6. Portability: Request the transfer of your data to you or a third party in a structured, commonly used format.

  7. Withdraw Consent: Withdraw your consent at any time where we are relying on consent (e.g., for marketing).

8. Complaints to the Supervisory Authority

We strive to resolve any query or concern you raise about our use of your information directly. However, you have the right to lodge a complaint with the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues.
